01About these terms
These terms are an agreement between you and Crypto Merchant (“we”, “us”), the crypto payment service at cryptomerchant.online, operated from Pakistan. They apply when you create an account and when you use the portal, the checkout pages or the API.
If you use Crypto Merchant for a business, you accept these terms for that business and confirm that you are allowed to. Please also read our Privacy Policy.
02Who can use Crypto Merchant
Anyone, in any country, can open an account. Setup is free and we don't ask for identity documents.
You must be old enough to enter into a binding contract where you live, and you must be allowed to use a service like this under the laws that apply to you. You are responsible for following those laws, including any tax, licensing and reporting rules for your business.
We may refuse to open an account or to work with a business.
03Prohibited uses
You may not use Crypto Merchant, directly or indirectly, for:
- anything illegal where you or your customers are, including selling illegal goods or services;
- illegal drugs, weapons or explosives;
- child sexual abuse material, or any content that exploits minors;
- fraud, scams, phishing, Ponzi or pyramid schemes, or misleading customers about what they are paying for;
- money laundering, terrorist financing, or hiding where money comes from;
- evading sanctions, or dealing with people, organisations or regions under sanctions;
- stolen goods, stolen data or stolen accounts;
- malware, hacking services or attacks on other people's systems;
- goods or content that infringe other people's intellectual property;
- gambling where it is not legal;
- attacking, overloading or trying to get around the security of Crypto Merchant itself.
If we believe an account is being used for any of these, we may stop its payments and payouts, close it, and share information with the authorities where the law requires it.
04Your account and your team
Keep your password and two-factor codes safe. You are responsible for everything done with your account, including by team members you invite.
Admins can do everything, including payouts. Managers can do everything except moving money out and managing the team. Staff can only view. Give each person the lowest role they need.
Keep API keys and webhook secrets secret. If you think one has leaked, revoke it straight away.
05How custody works
Crypto Merchant is a custodial service. We create and hold the private keys of your pool wallet and of the deposit addresses used for your invoices, and we move coins on your instructions. You don't receive these private keys.
Every wallet is derived from one master recovery phrase using the BIP-39 and BIP-44 standards. The operator keeps the phrase offline, on paper, so addresses can be rebuilt even if our servers are lost.
The balance in your portal is our record of the coins we hold for your business. Coins stay in the coin and on the network they were received in, unless you choose to have them swapped.
Crypto Merchant is not a bank. Balances don't earn interest and are not covered by any deposit insurance or government protection scheme.
06Payments and sweeps
Each invoice gets a deposit address. A payment counts only after it is confirmed on its blockchain. It is then moved (“swept”) into your pool wallet, automatically or when you start a sweep, as you chose at setup.
Customers must send the coin shown, on the network shown, before the invoice expires. Coins sent on the wrong network, as a different coin, or to an expired invoice may be delayed or lost, and we can't guarantee that they can be recovered.
Deposit addresses are reused after a cool-down period. Don't ask customers to pay to an address outside a current invoice.
07Fees
- Payment fee: 1% of each paid invoice, deducted when the payment is credited to your balance. Expired and cancelled invoices have no fee.
- Setup: free.
- Go-live payment: to start accepting payments, you make a one-time payment of $25 in any coin. It is credited in full to your gas balance. The gas balance only pays network fees: it can't be withdrawn, refunded or paid out as cash.
- Network fees: blockchains charge fees to move coins. Network fees for sweeps and swaps are paid from your gas balance. We add no fee of our own on top of the network fee for sweeps. If your gas balance runs out, the network fee is taken from the payment being moved.
- Swaps: swap rates include a service margin for Crypto Merchant.
We may change our fees. We will publish new fees on this site and tell you by email or in the portal before they apply. A change never applies to invoices that were already paid.
08Underpayments and overpayments
- Underpayment. You set an underpayment tolerance in your settings; we recommend at least $1. If a confirmed payment is short by no more than the tolerance, the invoice counts as paid. If it is short by more, the invoice is underpaid: what was received is held for the customer, who can pay the rest or ask for a refund of what they sent.
- Overpayment of more than $5. The invoice counts as paid, and the customer can withdraw the extra amount.
- Overpayment of $5 or less. The invoice counts as paid, and the extra amount goes to the Crypto Merchant platform pool. It is not paid to you and is not returned to the customer.
These rules apply to every invoice, and you agree that we apply them on your behalf. Ask your customers to pay the exact amount shown.
09Payouts and payout addresses
You can pay out your balance at any time, with no minimum, to payout addresses you save in the portal. Only Admins can save payout addresses and make payouts.
You are responsible for giving correct addresses on the correct networks. Crypto transfers are irreversible: once a payout is sent, we can't cancel, reverse or recover it.
We may delay a payout to check that it is genuine, to protect your account, or while a blockchain is congested or unavailable.
10Swaps
If you choose a holding coin, your coins are swapped into it automatically every 24 hours or when you request a payout. Rates are based on market prices at the time of the swap and include our service margin. Prices change all the time, and we are not responsible for losses from price movements.
Nothing on Crypto Merchant is investment, financial or tax advice.
11Testnet and mainnet
Crypto Merchant can run on test networks (testnet) or on the real networks (mainnet). Coins on testnet have no value, and API keys there start with cm_test_. Never send real coins to a testnet address: they can be lost for good. On mainnet, API keys start with cm_live_ and every payment is real.
12Pausing and closing accounts
You can stop using Crypto Merchant at any time. Pay out your balance first, then ask us to close your account.
We may pause or close an account, or hold its payments and payouts, if we reasonably believe it breaks these terms or the law, puts customers or other merchants at risk, or if the law or an authority requires it. Where we are allowed to, we will tell you why.
When an account is closed, we let you withdraw the balances that belong to you, unless the law stops us or the funds are connected to a prohibited use. The gas balance, including the go-live payment, is not refunded as cash.
13Your customers
You are the seller. You are responsible for what you sell, for your prices, refunds and customer service, and for any taxes on your sales. Crypto Merchant only processes the payment.
14Availability
We work to keep Crypto Merchant running, but it is provided “as is” and “as available”. Blockchains, nodes, exchanges and other services we rely on are outside our control and can be slow, congested or down.
15Limits on our liability
As far as the law allows, we are not liable for indirect or consequential losses, lost profits, losses from price movements, losses caused by blockchains or other third parties, or losses caused by wrong addresses or networks given by you or your customers.
As far as the law allows, our total liability to you for any claim is limited to the fees you paid us in the three months before the claim arose.
Nothing in these terms limits any liability that can't be limited by law.
16Indemnity
You agree to cover our reasonable losses and costs from claims by others that come from your business, your sales or your breach of these terms.
17Changes to these terms
We may update these terms. We will post the new version on this page with a new date and, for important changes, tell you by email or in the portal before they take effect. If you keep using Crypto Merchant after that, the new terms apply.
18Law and disputes
These terms are governed by the laws of Pakistan, and the courts of Pakistan decide disputes about them. Before going to court, please write to us so we can try to solve the problem together.
19Translations
These terms may be shown in other languages for convenience. If a translation differs from the English version, the English version is legally binding.
